Terms and Conditions of the SanSanWare.COM Online Store

1. General

1.1 These terms and conditions govern the conditions between the company SanSan OÜ (hereinafter referred to as the "Seller"), which manages the SanSanWare.COM online store, and the customer (hereinafter "Buyer") who places an order through the online store. By registering as a user of the service or purchasing products from the SanSanWare.COM online store, the Buyer agrees to these purchase terms (hereinafter "Terms") and undertakes to abide by them.

1.2 In addition to these Terms, legal relationships arising from purchasing products through the SanSanWare.COM online store are governed by the legislation of the Republic of Estonia.

1.3 The Seller reserves the right to make changes to the offered online store service at any time.

1.4 The Seller reserves the right to unilaterally amend the Terms of the user agreement without being obliged to notify the Buyer in writing via email. Changes and additions to the Terms and pricing will be announced on the website www.SanSanWare.COM.

2. Price List

2.1 All prices displayed in the online store are in euros and include a 24% value added tax.

2.2 The Seller reserves the right to change the prices displayed in the online store at any time. If prices have been changed in the online store after the Buyer has placed an order and paid for it, the Seller undertakes to deliver these products to the Buyer at the price valid at the time of ordering. The Buyer is not entitled to claim compensation for any price difference.

3. Products and Placing an Order

3.1 An order is created for the Buyer when they press the "Add to Cart" button next to the product.

3.2 The shopping cart shows the selected products and the shipping costs added to the price, based on the address provided by the Buyer.

3.3 The Buyer may add, exchange, or remove products from the shopping cart before finalizing the order.

3.4 When the Buyer has selected the desired products, they commit to providing the necessary information for placing the order and pay for the products by credit card or bank transfer based on a pro forma invoice.

3.5 When placing an order, the Buyer agrees to provide accurate information. The Seller is not responsible for any consequences arising from incorrect information provided by the Buyer that leads to failure to deliver the order or any other issues.

3.6 The sales contract is considered concluded when payment for the Buyer's ordered product is received into the Seller's bank account.

3.7 Product images presented are for illustrative purposes and may differ from the actual product.

4. Payment for Products

4.1 The Buyer may pay for products by credit card or direct bank transfer based on a pro forma invoice.

4.2 Payment of the invoice for the products must be made in advance within 5 days of the invoice date.

4.3 The order and invoice are void if the Buyer has not paid the advance payment within 5 business days from the date of invoice issuance.

4.4 If the Buyer pays with a gift card that exceeds the purchase amount, the Seller does not refund the unused portion of the gift card value. If the value of the gift card is exceeded, the Buyer pays the excess amount under the aforementioned conditions. The gift card cannot be exchanged for cash and is valid for 180 calendar days from the date of issue, unless otherwise specified.

5. Delivery of Products

5.1 Once the contract comes into force under Clause 3.6 of the Terms, the ordered products will be delivered to the Buyer within 14 business days from the date the contract comes into force, and this will be done according to the delivery method chosen by the Buyer when placing the order. The delivery time may vary depending on the product. If the ordered product is out of stock, the Seller undertakes to inform the Buyer promptly and refund the paid amount promptly.

5.2 If the delivery time exceeds 30 business days and the Buyer loses interest in purchasing the product, they have the right to cancel the order. In such cases, the Seller will refund the advance payment to the Buyer's bank account promptly.

5.3 When placing the order, the Buyer must ensure the accuracy of the information provided to avoid delays and misunderstandings in product delivery. The Seller is not responsible for delays or misunderstandings in product delivery if they are caused by inaccurate or incorrect information provided by the Buyer when placing the order.

5.4 If the chosen delivery method involves a courier service selected by the Buyer, and the Seller has delivered the ordered products to the courier company, the courier company will contact the Buyer in advance to specify the delivery time. The Buyer or their authorized person must be available at the agreed time and place to receive the products from the courier. If, due to reasons attributable to the Buyer, it is not possible to deliver the products within 7 days from the agreed time, the products will be returned to the Seller. The Seller is obligated to refund the amount paid by the Buyer for the products, minus the return shipping costs.

5.5 If a courier is chosen as the delivery method, they will deliver the products to the Buyer along with a delivery note. The Buyer must inspect the package before signing the delivery note. If there are external damages to the package, the Buyer has the right to refuse acceptance of the product. By signing the delivery note, the Buyer confirms that the packaging was intact and showed no visible signs of damage at the time of delivery, and that they were satisfied with the condition of the packaging. If a product with damaged packaging is refused, it must be returned to the courier, and the Seller must be notified by email at support@SanSanWare.COM.

5.6 Home delivery requires that access roads are in good condition so that the delivery truck can reach the designated address. If it turns out that the condition of the road, among other characteristics (such as very narrow roads) or weather conditions, prevents the delivery truck from reaching the address, the Buyer must arrange with the driver where the order will be loaded from the truck and handed over to the Buyer. The courier's delivery service does not include internal building transport.

5.7 These delivery terms apply only to orders delivered to mainland Finland. For orders to Åland, archipelago areas, or abroad, please contact customer service at support@SanSanWare.COM to confirm if delivery is possible and if it incurs additional costs.

5.8 If the Buyer notices upon opening the package that the goods have been damaged during transport or are otherwise dissatisfied with the quality of the goods, the Buyer must notify the Seller as soon as possible, no later than 3 days from the delivery of the goods. Notification must be sent in writing to support@SanSanWare.COM and include photographs of the damaged goods.

6. Cancellation of Order and Return of Product

6.1 If the Buyer wishes to withdraw from the contract after placing an order and before the Seller has delivered the order, they must notify the Seller in writing as soon as possible. Written notification should be sent to support@SanSanWare.COM and must include the order number from which the Buyer wishes to withdraw, as well as the first name, last name, order date, and telephone number. In such cases where the order has not yet been handed over to the courier company, the Seller is obliged to cancel the order.

6.2 The Buyer has the right to withdraw from the purchase contract within 14 calendar days from receiving the product. To return the product, the Buyer must send a notification to the Seller's email address support@SanSanWare.COM or complete the cancellation form on the SanSanWare.COM website.

6.3 The product must be returned in its original packaging. The product and its packaging must not be damaged or show signs of use. In the event of deterioration of the returned product due to use, the Buyer is responsible for the decrease in value resulting from use other than what is necessary to ascertain the nature, characteristics, and functioning of the product. For this purpose, the Buyer agrees to handle the product only as would be possible in a regular store. Products made or ordered specifically for the Buyer's special request are not eligible for return by the Seller.

6.4 When withdrawing from the purchase contract, the Buyer is responsible for the costs associated with returning the product, except in cases where the returned product did not correspond to the Buyer's order.

6.5 If the Buyer has damaged or destroyed the product or its packaging, the Seller has the right to demand compensation for the decrease in the product's value.

6.6 The Buyer is obligated to return the product within 14 calendar days from the date the cancellation notice is received by the Seller.

6.7 Upon returning the product, the Seller will refund the amount paid by the Buyer within 14 calendar days from receiving the notice of contract withdrawal and the returned product. The refund will be made to the same bank account from which the payment for the product was made to the Seller.

6.8 The Buyer does not have the right of withdrawal for ordered services (including installation services).

6.9 The right of withdrawal does not apply if the Buyer is a business entity.

7. Right to Complaints and Returning Non-Conforming Products

7.1 The Seller is responsible for non-conformity and defects in the products that become apparent within 2 years from the delivery of the products to the Buyer. If the manufacturer has granted a longer warranty period for the product beyond two years, it will be indicated in the product card under "Features."

7.2 In case of product non-conformity or defects, please send a complaint by email to support@SanSanWare.COM, including the name and contact details of the person who placed the order (including bank account number), order number, and a detailed description of the product's non-conformity or defect.

7.3 In the event of non-conformity or defects in the product, the Buyer is entitled to the following remedies: elimination of non-conformity, repair or replacement of the product, or reduction of the price paid by the Buyer, or refund of the price paid and return of the product.

7.4 The Seller is not responsible for the non-conformity or defects in the product that occurred after the delivery of the product to the Buyer due to improper use, maintenance, or storage.

7.5 If the Buyer exercises the right to complain within 2 months from the occurrence of the non-conformity or defect, it is considered to have occurred during the delivery of the product.

8. Disputes and Governing Law

8.1 Disputes arising from the purchase of products through the SanSanWare.COM online store are resolved by negotiations between the parties. If no agreement is reached, the Buyer has the right to turn to the Consumer Disputes Board (https://www.kuluttajariita.fi/) for a resolution.

8.2 Disputes arising from the contract are governed by the legislation of the Republic of Estonia.

9. Personal Data

9.1 The Seller processes the Buyer's personal data in accordance with applicable law and our Privacy Policy, which is available on the website www.SanSanWare.COM.

9.2 By using the SanSanWare.COM online store, the Buyer agrees to the processing of their personal data in accordance with the Seller's Privacy Policy.

10. Final Provisions

10.1 By ordering products from the SanSanWare.COM online store, the Buyer agrees to these Terms.

10.2 The Terms come into force on 01.01.2024.
